Aşa-zisa luptă împotriva fenomenului corupţiei este o metodă de a-i supune pe cei neascultători. Este opinia judecătorului Domnica Manole, pe numele căreia a fost intentat un dosar penal după ce aceasta a dispus organizarea referendumului privind alegerea preşedintelui de către popor.

„Pretinsa luptă contra corupţiei este, de fapt, o manipulare - o manieră de a-i îngenunchea pe cei „neascultători” şi de a-i avertiza pe cei care se pregăteau să iasă din captivitate. Oare de ce procurorul general se face a nu vedea hotărârile judecătoreşti prin care au fost scoase milioane din bugetul de stat, hotărâri în baza cărora au fost efectuate operaţiuni de spălare a miliarde de dolari prin sistemul bancar naţional, a fost devalizat întregul sistem bancar? În schimb îl vedem cum se chinuie să obţină sancţionarea judecătorilor care, în virtutea legii, au pronunţat hotărâri contrare aşteptărilor puterii politice. Oare nu este clară misiunea reală a acestui luptător contra corupţiei?”, a declarat Domnica Manole în cadrul unui interviu pentru report.md.

Magistrata mărturiseşte că intenţionează să demonstreze comunităţii internaţionale în ce hal a ajuns justiţia din Republica Moldova prin procesul de contestare a actelor procesuale emise împotriva sa.

„Prin procesul iniţiat în instanţele judecătoreşti de contestare a tuturor actelor procesuale emise în privinţa mea, vreau sa demonstrez societăţii şi comunităţii internaţionale care este scopul real al acestui proces penal. Vreau ca societatea si comunitatea internaţională să înţeleagă cum stau lucrurile în justiţia din Republica Moldova – să înţeleagă în ce hal a ajuns justiţia”, subliniază judecătoarea.

De asemenea, Manole accentuează faptul că s-a angajat în această luptă nu pentru a câştiga, ci pentru a le da oamenilor o speranţă şi a demonstra celor care şi-au subordonat justiţia că mai există judecători care pot opune rezistenţă.

„Cei care cred că şi-au subordonat justiţia trebuie să înţeleagă că sunt încă judecători cu verticalitate care le pot opune rezistenţă. M-am angajat în această luptă, nu pentru a câştiga, ci pentru a le da oamenilor o speranţă. Vreau să încerc să demonstrez că încă nu este totul pierdut… O dovadă a celor menţionate este modul în care a fost amânată examinarea cererii de recuzare de către secretariatul Curţii Supreme de Justiţie. Instanţa de judecată, care avea obligaţia de a deschide şedinţa şi de a dispune amânarea şedinţei cu stabilirea termenului de judecare a cauzei, a lăsat judecarea cauzei la discreţia secretariatului, care a convocat pretinsa şedinţă de judecată în holul instanţei. Culmea, în prezenţa reprezentanţilor ambasadelor şi a presei”, spune Domnica Manole.

În aceeaşi ordine de idei, judecătoarea opinează că CSM şi CSJ promovează iniţiative legislative în detrimentul sistemului judecătoresc.

„CSM nu vrea să promoveze judecătorii în mod transparent şi pe bază de meritocraţie. Am fost şi mai suntem martori la promovarea unor iniţiative legislative în detrimentul sistemului judecătoresc de către conducerea CSM şi a CSJ, instituirea unor practici sovietice de impunere a unui mod viciat de judecare – tentative curmate recent de Curtea Constituţională. E firesc ca atunci când sesizezi aceste jocuri să suspectezi CSM de faptul că nu apără interesele sistemului judecătoresc, ci anumite interese străine”, a conchis magistrata.

“The alleged fight against corruption is, in fact, a manipulation – a manner to kneel the “disobedient” ones and to warn the ones who were preparing to come out from captivity. I wonder why the Prosecutor General pretends not to see the court decisions basing on which millions were removed from state budget, decisions basing on which operations of money laundry of USD billions were effectuated through the national banking system, the whole banking system was embezzled? Instead, we see him trying to obtain the sanctioning of the judges who, under the law, pronounced decisions contrary to the political power expectations. Isn't it clear the real mission of this fighter against corruption?”, declared Domnica Manole in an interview for the report.md.

The magistrate confesses that intends to demonstrate to the international community the miserable situation in which is the justice from the Republic of Moldova through the process of challenging of the procedural acts issued against her.

“Through the process initiated in courts of challenging of all procedural acts issued on my regard, I want to demonstrate to society and international community the real purpose of this criminal process. I want the society and the international community to understand how the things unfold in the justice from Moldova – to understand the miserable situation from justice”, emphasizes the judge.

Also, Manole emphasizes the fact that she has engaged into this fight not to win, but to give to people hope and to demonstrate to the ones who have subordinated justice that there are still judges who can oppose resistance.

“Those who have subordinated justice have to understand that there are still judges with uprightness who can oppose resistance. I have engaged into this fight not to win, but to give to the people hope. I want to demonstrate that not everything is lost yet... A proof of the mentioned things is the way in which was delayed the examination of the request of recusal by the Supreme Court of Justice (CSJ) secretariat. The court, that was obliged to open the hearing and dispose the cancellation of the hearing with the establishment of the term of the case hearing, left to the discretion of the secretariat the proceeding, that convoked the alleged hearing in the court hall. To crown all, in the presence of the embassies' representatives and the press”, says Domnica Manole.

On the same train of thoughts, the judge thinks that the Superior Council of Magistracy (CSM) and the CSJ promote legislative initiatives in the detriment of the judiciary.

“The CSM does not want to promote the judges transparently and basing on meritocracy. We were and still are witnesses at the promotion of some legislative initiatives in the detriment of the judiciary by the CSM and the CSJ leadership, the institution of some soviet practices of imposition of a stale way of judging – attempts recently ceased by the Constitutional Court. It is normal when you take note of these games to suspect the CSM of the fact that it does not defend the interests of the judiciary, but certain strange interests”, concluded the magistrate.
